Terms of Service

1. The Service

Catch is a communication service that helps you share when you are available for a spontaneous voice call with people you know and place or receive real-time voice calls. Features may include account creation through supported sign-in providers, phone-number verification, optional contact matching, availability status, call notifications, and call-history information. We may add, change, suspend, or discontinue features over time.

2. Eligibility

You must be at least 13 years old to use Catch. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. You may not use the Service if you are prohibited from doing so under applicable law. By using Catch, you represent that you meet these requirements.

3. Your account

You agree to provide accurate information, keep your account information current, and protect access to your account and devices. You are responsible for activity that occurs through your account. Notify us promptly at help@letscatch.com if you believe your account has been accessed without permission. You may not transfer your account or impersonate another person.

4. Acceptable use

You agree not to use the Service to:

• harass, threaten, abuse, stalk, defame, or harm another person;
• engage in unlawful, fraudulent, deceptive, or exploitative conduct;
• place unwanted or repeated calls, send spam, or violate another person’s privacy;
• share content that is illegal or infringes another person’s rights;
• attempt to gain unauthorized access to the Service, another account, or our systems;
• interfere with, disrupt, reverse engineer, scrape, or misuse the Service;
• upload malware or use automated means to access the Service without permission; or
• help or encourage anyone else to do any of the above.

You are responsible for your communications and interactions with other users. Exercise good judgment and respect other people’s boundaries and consent.

5. Privacy

Our Privacy Policy explains how we collect, use, and share information in connection with the Service. By using Catch, you acknowledge those data practices.

6. SMS and Mobile Messaging Terms

If you request phone-number verification, Catch may send a one-time verification code to the mobile number you provide. Messages are sent only at your request. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.

You represent that you are authorized to use the mobile number you provide and consent to receive the requested verification message at that number. Consent to receive SMS messages is not a condition of purchasing any goods or services. For help, contact help@letscatch.com.

7. Our rights

The Service, including its software, design, branding, and other content we provide, is owned by Lets Catch or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. These Terms do not grant you any other rights in the Service or our trademarks.

8. Suspension and termination

You may stop using Catch at any time and may request account deletion in the app or by contacting us. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, misuse the Service, or if needed to protect users, third parties, or the Service. Where reasonable, we will provide notice. Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, limitations of liability, and governing-law provisions.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LETS CATCH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT CALLS OR NOTIFICATIONS WILL ALWAYS CONNECT OR ARRIVE.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETS CATCH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$100. The limitations in this section apply only to the extent permitted by applicable law.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in that state, and you and Lets Catch consent to the jurisdiction of those courts, except where applicable law requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. If we make changes, we will post the updated Terms at this stable URL and revise the “Last updated” date above. If a change is material, we may provide additional notice. Your continued use of the Service after the updated Terms take effect means you accept the changes.

13. General terms

These Terms and the Privacy Policy are the entire agreement between you and Lets Catch regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
